Sub-contracting arrangements

In line with the requirements set out in the recently published 2010/11 Funding Requirements for Apprenticeship and Train to Gain, colleges and providers are requested to notify the Skills Funding Agency of their sub-contracting arrangements. A declaration form has been developed to collect the required information on sub-contractors.

Colleges and providers should send the completed declaration form to their Account Manager, also copying the procurement team central email address by the 13 October 2010.

This will allow a complete national picture of sub-contractors and sub-contracting to be established for the first time. The declaration form needs to be re-submitted whenever new sub-contract arrangements are agreed.

This declaration form replaces the form at Annex I: ILR Partner-provider details from LSC Funding Guidance 2008/09: ILR Funding Claims and Audit Returns (Published September 2008). Should a college or provider have already submitted details of their proposed sub-contractors for 2010/11 to the Skills Funding Agency using the form at Annex I then there is no need to complete the new spreadsheet for the coming year.

In addition to this information on individual sub-contractors, each contracted College or provider will be required to provide the Skills Funding Agency with a single signed declaration that the necessary due diligence has been carried out across all proposed sub-contractors. It is for the contracted college or provider to determine the necessary and sufficient due diligence required.

The 2010/11 Funding Requirements for Apprenticeship and Train to Gain published by the Skills Funding Agency set out some of the areas that providers may want to consider when carrying out due diligence, particularly for those sub-contractors that represent a higher level of risk based on, but not restricted to, the value and nature of the sub-contracted programmes and/or provision.

Colleges and providers are also reminded of the need to notify the Skills Funding Agency through their Account Manager if there is a significant change to the amount and/or nature of any sub-contracted provision from that already declared.
